2. Subject of data protection

The subject of data protection is personal data. According to Article 4 No. 1 GDPR, these are all information that relates to an identified or identifiable natural person (data subject). A natural person can be identified by certain information, such as name, residential or postal address, telephone number and, if applicable, usage data. 3. What data does REC use and where does this data come from?

REC process personal data from customers and contact persons of customers, which it receives from them in the context of a business relationship or the initiation of a business relationship.

 

3.1 This also includes the data received in the context of a contact by the customer via our contact form on the above-mentioned homepage. This includes the following categories of data: personal master data (name, occupation, industry or business name); contact data (address, telephone number, e-mail address); payment data (bank data); business history data (offers, orders, sales, delivery addresses);

3.3 The REC Academy regularly offers various events (workshops, conferences, seminars). These are announced on the website and in information emails. In order to participate in such events, you must register via the online registration forms provided for this purpose on our website. For this purpose, it is necessary that you provide certain information about yourself as well as contact details (e.g. name, address, email address, etc.). This data is stored by us exclusively for organisational reasons. In addition, the data will be used for the purpose of providing further information about upcoming REC events. 4. For what purposes does REC process your data and on what legal basis?

REC processes your personal data in compliance with the requirements of the European Data Protection Regulation (GDPR) and national data protection legislation for the following purposes:
We process your personal data for the purpose of fulfilling the contract, including processing payments, handling complaints, warranty claims and returns. In addition, we process your data prior to the conclusion of a contract insofar as you request information about our products and services. In this case, the processing is based on Art. 6 (1) sentence 1b) DSGVO.
Furthermore, we process your personal data if you have given us your consent to do so. In this case, the basis for the processing is Art. 6 (1) sentence 1a) DSGVO. To obtain consent, we will inform you in advance about the specific purpose of the intended processing. You can revoke consent given to us (including consent given before 25.05.2018) at any time with effect for the future. The revocation can be made at any time without compliance with a special form to the above contact details.
Finally, we process your data if we have a legitimate interest in doing so, but only to the extent that your interests or fundamental rights require the protection of your personal data. The basis for the processing in this case is Art. 6 para. 1 sentence 1f) DSGVO. 5. Who does REC share your data with?

Within REC, your data is passed on to those departments that need it to fulfil the contract or to carry out pre-contractual measures (e.g. financial accounting).

Where necessary, we also pass on data to service providers who support us (e.g. postal service providers, logistics companies, IT service providers, debt collection service providers and legal advisors).
Your data will be passed on to third parties outside REC to financial authorities for the fulfilment of reporting and verification obligations and to law enforcement authorities if there is a legal obligation to do so.


6. How long will your data be stored by REC?

Your personal data will be stored for the duration of the performance of the contract. If your data is subject to a legal retention period (under tax law, commercial law, or similar), we store this data until the expiry of the legally stipulated periods. These periods are, for example, 6 years for tax law regulations and 10 years for commercial law regulations.


7. Information on customers' data protection rights

Every customer has the right to information about his or her data stored at REC and the processing thereof in accordance with Art. 15 DSGVO, the right to correction of his or her data in accordance with Art. 16 DSGVO, and the right to deletion of his or her data after fulfilment of the contract in accordance with Art. 17 DSGVO, provided that there are no storage obligations to the contrary. In addition, there is the right to restriction of processing according to Article 18 of the GDPR, as well as the right to object (Article 21 of the GDPR) and data portability (Article 20 of the GDPR).
You can revoke a previously given consent to the use of your data at any time without affecting the lawfulness of the processing carried out on the basis of the consent until revocation.
There is a right of appeal to a competent data protection supervisory authority in accordance with Art. 77 DSGVO.
